The article examines the recent case of Haji-Ioannou v Frangos where the Court of Appeal considered the question of whether delay in commencing detailed assessment proceedings constituted misconduct within the meaning of CPR r.44.14 and therefore merited sanction beyond the disallowance of interest prescribed by CPR r.47.8.
