C began professional negligence proceedings against 2 firms of solicitors concerning leases of commercial premises. One of the firms (D1) agreed to pay C's claim and withdrew its contribution claim against the other firm (D2). D2 would not agree that C could discontinue with no order for costs so C served a notice of discontinuance on D2 and sought an order that there should be no order for costs. The 1st instance judge made such an order and D2 appealed.
